Terms of Service
These terms cover your use of PenguCrush, provided by Digital Chocolate. Read them alongside our Privacy Policy.
Playing the game
You may install and play PenguCrush for personal, non-commercial entertainment, subject to these terms and applicable law. If you cannot legally agree to these terms yourself, a parent or guardian must review and permit your use where required. If you do not agree, do not use the game.
Fair play and permitted use
Do not use the game to harm other people, interfere with its operation, distribute malicious software or infringe another person’s rights. Do not sell access, impersonate the publisher or redistribute game artwork or code without permission, except where a license or applicable law permits it. Statutory rights to inspect, modify or reverse engineer software are not restricted beyond what the law allows.
Shells, boosters and rewards
Shells, stars, boosters, relics and quest rewards are virtual game items. They can be earned through play. Fixed booster packs can also be purchased with SOL, at the price shown before opening your wallet. Each completed level offers an optional leaderboard submission for 0.01 SOL, plus the Solana network fee shown by the wallet. Payment is never required to continue playing. There are no subscriptions, paid loot boxes, withdrawals or real-money prizes. They have no cash value and cannot be transferred or exchanged outside the game. Reward conditions appear in the game. We may correct bugs or change future balance and content.
Approving a purchase
Purchases use Solana mainnet and are approved in your installed wallet. A sign-in signature does not transfer funds. A separate transaction transfers the displayed SOL amount to the publisher and incurs the network fee. Credit is granted only after the server verifies a finalized transaction. If returning from the wallet is interrupted, use Pack → Check status before retrying. A declined wallet request does not grant an item. Blockchain transfers are irreversible; contact support about an incorrect payment or missing items. Mandatory consumer refund and remedy rights remain applicable. Packs are fixed consumables delivered to the installation where purchased, without cash value or guaranteed cross-device restoration.
Leaderboard rules
The board displays each wallet’s highest submitted score per level. Overall rank is the sum of those best scores, with earlier achievements breaking ties. The server replays moves to verify the result. Offline game data and booster balances are stored locally, so this is a casual leaderboard without monetary prizes or a guarantee that every client is untampered. A paid submission may not improve your existing best score.
Local saves and availability
Progress is saved on the device, without an online account or cloud-save recovery. Deleting the save, clearing app data, uninstalling or losing the device can permanently remove progress. The game may change through updates, and compatibility or availability may change. We do not promise continuous availability or a particular result from playing.
Notifications and links
Reminders and cloud announcements are optional and can be changed in Settings. Receiving or opening a message never spends shells or automatically grants a reward. Any reward still requires meeting its in-game conditions. External links and email open services with their own terms and privacy practices.
Ownership and third-party licenses
The game, characters and other creative material belong to the publisher or their respective licensors, subject to applicable law and the third-party licenses listed in the app. These terms grant permission to play; they do not transfer ownership. Open-source license rights continue to apply.
Your legal rights
We do not exclude or limit consumer rights, warranties, remedies or liabilities that cannot lawfully be excluded or limited. Where the law permits, the game is provided as available without additional promises beyond those stated here. Any dispute is subject to the mandatory consumer protections and court rights that apply to you.
Stopping use and updates
You can stop using the game at any time and delete your save from Settings. We may update these terms for changes to the game or legal requirements and will make the current version available in the app. For support or questions about these terms, email digitalchocolate@gmail.com.
